Privacy policy

1. Scope

This policy describes how Janover Capital LLC ("Janover Capital," "we," "us") collects, uses, shares and protects information in connection with lihtc.loans (LIHTC Atlas, the "Site"), which is operated by Janover Capital LLC. It covers this Site only. Janover's other websites and the outside sites we link to have their own policies. By using the Site you agree to this policy and to our Terms of use.

2. Information we collect

What you type into a form. The Site's forms collect only these fields:

  • Financing request (the financing page): your role, the property state, city or county, credit type, number of units, total development cost or value, the financing you need, the stage, anything else you add, your name, work email, phone (optional) and company
  • Contact form (the contact page): your name, email, phone (optional) and message

Every request form also sends hidden fields: the page you sent it from, the consent sentence shown next to the button, any campaign tags (utm) in the link that first brought you to the Site, and the referring page, and, on the financing request, the last result from the credit estimator if you ran it in the same visit. There is also an empty field that people can't see, used to catch spam programs.

Alert sign-ups. The alert forms on the county income limit pages, the QCT and DDA page and the data page collect your email address, which alert you want (new income limits or new QCT and DDA lists), the state, county and county code of the page you signed up on, and the box you tick to agree to alert emails. Sign-ups are stored in our Cloudflare database. Alert emails have not started yet; when they do, the first one asks you to confirm, and every one has a one-click unsubscribe link that also lets you delete the sign-up.

Tools and lookups. The credit estimator runs entirely in your browser; the numbers you enter are not sent to us, except that the result is kept in your browser for the visit so it can be attached to a financing request you choose to send. The QCT and DDA check sends the address you type to our server, which passes it to the U.S. Census Bureau's public geocoder to find the census tract, then compares the tract with HUD's lists. We do not store or log the address; the Census Bureau's own privacy policy covers its geocoder. The income limit and apartment pages are plain pages and collect nothing.

What is collected automatically. Our hosting provider, Cloudflare, processes standard technical data when you load a page, such as your IP address, approximate location derived from it, browser and device type, the pages you request and the referring page, to deliver the Site and protect it from abuse.

The Site runs no analytics or advertising tools.

Information from other sources. If you ask us to work on financing, we may receive information about you or your property from public records, lenders and other parties to the transaction, such as appraisers or title companies.

3. How we use information

We use information to reply to your request and, if you ask, to evaluate, size and arrange the financing you asked about; to contact you about your request as described in section 5; to run, secure and improve the Site; to meet legal, tax and regulatory duties; to enforce our Terms; and to detect and prevent fraud and abuse. We may use aggregated or de-identified information, which doesn't identify you, for any lawful purpose.

4. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not pass your request to lenders, partners or lead buyers on our own. We share it only as follows:

  • Lenders and transaction parties, at your direction. If you ask us to arrange financing, we share deal and contact details with prospective lenders and the parties needed to evaluate or close it (for example appraisers, title companies and counsel).
  • Service providers. Cloudflare hosts the Site, stores form submissions and alert sign-ups in its D1 database, and delivers your request to our team by email. They act for us and only for that purpose.
  • Affiliates. Affiliated Janover businesses, for the purposes in this policy.
  • Professional advisors. Our lawyers, accountants and insurers, as reasonably needed.
  • Legal and safety. When we believe disclosure is required by law, subpoena or legal process, or needed to enforce our agreements or protect the rights, property or safety of Janover Capital, our clients or others.
  • Business transfers. As part of a merger, acquisition, financing or sale of all or part of our business.

5. Communications and your choices

If you send a request with your contact details, we may contact you about it by phone, text and email, as the consent sentence next to each form says. Consent is not a condition of any service. You can opt out of texts by replying STOP, out of marketing email with the unsubscribe link, or by calling (561) 559-4111 or writing to hello@lihtc.loans. We may still send messages that relate to an active request or transaction.

6. Cookies and similar technologies

The Site sets no cookies of its own. While you browse, it keeps the first page you landed on, the referring page and any campaign tags in your browser's session storage, which clears when you close the tab, so a form you send can include them. Cloudflare may set a strictly necessary security cookie if it needs to screen traffic. Your browser settings can block or delete cookies and the Site still works. The Site does not respond to "Do Not Track" signals. Where the law requires it, we honor opt-out preference signals such as Global Privacy Control; as noted above, we don't sell or share personal information for advertising.

7. Data retention

We keep information for as long as reasonably needed for the purposes in this policy, including transaction records, legal, tax and accounting requirements, disputes and enforcing agreements. Form submissions are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Security

We use commercially reasonable administrative, technical and physical safeguards. No method of transmission or storage is completely secure, and we can't guarantee absolute security. Please don't send Social Security numbers, account numbers or account credentials through the Site's forms; if a transaction needs sensitive documents, we will arrange a suitable channel.

9. Your privacy rights

Depending on where you live, you may have the right to know or access the personal information we hold about you, correct it, delete it, get a portable copy, or opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. To make a request, write to hello@lihtc.loans or call (561) 559-4111 with your name, contact details and what you are asking for. We may need to verify your identity first, and we won't discriminate against you for using your rights. Authorized agents may make requests with proof of authority.

10. Children

The Site is meant for adults. It is not directed to anyone under 18, and we don't knowingly collect personal information from them. If you believe a minor has sent us information, contact us and we will delete it.

11. Users outside the United States

The Site is run from and meant for users in the United States. If you use it from elsewhere, your information will be transferred to, stored in and processed in the United States, where privacy laws may differ from yours.

12. Third-party links

The Site links to government sources such as HUD's HUD User site, the IRS and govinfo.gov, and to the Creative Commons license text. This policy doesn't apply to those sites, and we aren't responsible for their privacy practices.

13. Changes to this policy

We may update this policy. The new version will be posted here with a new effective date. Using the Site after a change is posted means you accept it.
